SHIPPING AND RETURNS
WE WOULD LOVE FOR YOU TO BE HAPPY! If you are not enamored with your scents, then please reach out to us firstname.lastname@example.org.
Within 30 days you have always the option to return it to us for a refund.
In order to get a refund, your ScentClouds-mist must be unused. Unused for us means you have tried it out, made a couple of spritzer's and realized that it isn't your scent.
To complete your return, we require a receipt or proof of purchase.
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved your refund will be processed immediately, but please allow 3 - 5 days for the refund to show due to the nature of bank operating times.
Late or missing refunds (if applicable)
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next, contact your bank. There is often some processing time before a refund is posted.
If you’ve done all of this and you still have not received your refund yet, please contact us at email@example.com.
Only regular priced items may be refunded, unfortunately, sale items cannot be refunded.
You wanna change to different scent?
No problem we got you covered. Simply let us know within the first 5 days after the delivery of your original ScentCloud-mist and we will be happy to arrange an exchange scent for you. But please understand that we can only do that within the first 5 days of your purchase as usually, one realizes immediately if he or she likes the smell of a scent or not.
It's as easy as sending us an email at firstname.lastname@example.org to notify us and as soon as we receive the tracking information of your return-package we will send your item.
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.
If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

We hope for your understanding that we cannot pay for your own shipping costs for returning your item as we already offer Free Shipping.
Shipping costs are non-refundable. If you receive a refund, the cost of return shipping is arranged by us will be deducted from your refund.
Please understand that any return packages need to be shipped with tracking information and need to include your name and the order number to be able to verify your purchase.
We can ship to virtually any address in the world. Note that there are restrictions on some products, and some products cannot be shipped to international destinations.
There is a $500 USD minimum for international shipments.
When you place an order, we will estimate shipping and delivery dates for you based on the availability of your items and the shipping options you choose. Depending on the shipping provider you choose, shipping date estimates may appear on the shipping quotes page.
Please also note that the shipping rates for many items we sell are weight-based. The weight of any such item can be found on its detail page. To reflect the policies of the shipping companies we use, all weights will be rounded up to the next full pound.

ScentClouds - Malibu Fairies reserves the right to make adjustments to pricing and products for reasons including, but not limited to, changing market conditions, product discontinuation, product unavailability, manufacturer price changes and errors in advertisements. All orders are subject to product availability. Therefore, ScentClouds - Malibu Fairies cannot guarantee that it will be able to fulfil Customer's orders.
Limitation of Liability
NEITHER ScentClouds - Malibu Fairies NOR ITS AFFILIATES WILL BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR ANY CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. WHETHER A CLAIM FOR ANY SUCH LIABILITY IS PREMISED UPON BREACH OF CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY OF LIABILITY. NEITHER ScentClouds - MalibuFairies NOR ITS AFFILIATES WILL BE LIABLE FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST OR CORRUPTED DATA OR SOFTWARE. CUSTOMER AGREES THAT FOR ANY LIABILITY RELATED TO THE PURCHASE, DELIVERY OR USE OF PRODUCTS, NEITHER ScentClouds/Malibu Fairies NOR ITS AFFILIATES WILL BE LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES IN EXCESS OF THE DOLLAR AMOUNT PAID BY CUSTOMER FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
ScentClouds - Malibu Fairies will not be responsible for any delays in delivery which result from any circumstances beyond its control, including without limitation, product unavailability, carrier delays, error, delays due to fire, severe weather conditions, failure of power, labor problems, acts of war, terrorism, general insurrection, acts of God or acts of any government or agency. Any shipping dates provided by Malibu Fairies are estimates only. Please Note: All shipping delivery dates are based on business days. Weekends and holidays not included.
Any claim, dispute, or controversy (whether in contract, tort or otherwise, whether preexisting, present or future, and including statutory, common law, intentional tort and equitable claims) arising from or relating to the products sold pursuant to these Terms and Conditions of Product Sales, the interpretation or application of these Terms and Conditions of Product Sales or the breach, termination or validity thereof, the relationships which result from these Terms and Conditions of Product Sales (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories hereto), or ScentClouds - Malibu Fairies advertising and marketing (collectively, a Claim) WILL BE RESOLVED, UPON THE ELECTION OF ScentClouds - Malibu Fairies, CUSTOMER OR THIRD PARTIES INVOLVED, EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION. If arbitration is chosen, it will be conducted pursuant to the Rules of the American Arbitration Association. If arbitration is chosen by any party with respect to a Claim, neither Scent/Clouds - Malibu Fairies nor Customer will have the right to litigate that Claim in court or to have a jury trial on that Claim or to engage in pre-arbitration discovery, except as provided for in the applicable arbitration rules or by agreement of the parties. Further, Customer will not have the right to participate as a representative or member of any class of claimants pertaining to any Claim. Notwithstanding any choice of law provision included in these Terms and Conditions of Product Sales, this arbitration agreement is subject to the Federal Arbitration Act (9 U.S.C. 1-16). The arbitration will take place exclusively in Los Angeles, California, United States. Any court having jurisdiction may enter judgment on the award rendered by the arbitrator(s). Each party will bear its own cost of any legal representation, discovery or research required to complete arbitration. The existence or results of any arbitration will be treated as confidential. Notwithstanding anything to the contrary contained herein, all matters pertaining to the collection of amounts due to room4goods arising out of sales hereunder will be exclusively litigated in court rather than through arbitration.
Orders; Payment Terms; Interest; Taxes
Orders are not binding upon ScentClouds - Malibu Fairies until accepted by Malibu Fairies. Terms of payment are within Malibu Fairies sole discretion. Invoices are due and payable within the time period specified on the invoice, measured from the date of invoice, subject to continuing credit approval by ScentClouds - Malibu Fairies. Malibu Fairies may invoice Customer separately for partial shipments. Customer agrees to pay interest on all past-due sums at the lower of one and one-half percent (1 1/2%) per month or at the highest rate allowed by law. Customer is responsible for, and will indemnify and hold Malibu Fairies harmless from, any applicable sales, use, transaction, excise or similar taxes (but not taxes imposed or measured by ScentClouds - Malibu Fairies’ net income), and from any federal, state or local fees or charges (including, but not limited to, environmental or similar fees), imposed on, in respect of, or otherwise associated with the order. Customer must claim any exemption from such taxes, fees or charges and must provide Malibu Fairies with the necessary supporting documentation at the time of purchase. Any sales, use or other applicable tax or fees or assessments is based on the location to which the order is shipped. Shipping charges are not refundable. In the event of a payment default, Customer will be responsible for all of Malibu Fairies' costs of collection, including court costs, filing fees and attorneys fees.
